General Terms and Conditions (GTC)

1. Provider & Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) or entrepreneurs (§ 14 BGB) via the online shop Luneva-Fashion ( www.luneva-fashion.com) . ) complete.

Luneva-Fashion is a brand of KU&DE Global.
We do not recognize any conflicting or deviating conditions of the customer, unless we expressly agree to their validity in writing.

2. Conclusion of the contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the "Buy Now" button, you are making a binding offer to purchase. Confirmation of receipt of your order will be sent immediately after submission via automated email. The contract is concluded when we accept your order via a further email (order confirmation) or by delivery of the goods.

3. Contract Language & Storage

The language of the contract is German .
The contract text is not stored permanently. However, you will receive an email with all order details.

4. Right of withdrawal

Consumers have a statutory right of withdrawal .
You can find the terms and conditions and deadlines in our cancellation policy. (please provide a link).

5. Prices and Payment Terms

All prices are in Euros (€).
According to § 19 paragraph 1 of the German Value Added Tax Act (UStG), no value added tax is charged.
Therefore, the invoice amount does not include sales tax .

Shipping costs will be displayed separately during the ordering process.

Payment methods: The available payment methods (e.g. PayPal, Klarna, credit card, Apple Pay, Google Pay, Shopify Payments) will be displayed during the checkout process.

6. Delivery & Shipping

The delivery will be made to the delivery address provided by the customer.
The products are shipped directly from Asia to the customer.

Shipping time (approx.):

  • Germany & EU: 7–12 business days

  • International: 7–12 business days

Customs & Import Duties:

For deliveries to Germany and other EU countries from a third country, additional customs duties, taxes or import duties may apply. These are to be borne by the customer and are not covered by KU&DE Global.

Delays due to customs processing or the shipping service provider are beyond our control.

If the delivery of the goods fails due to incorrect address information or non-collection, the customer shall bear the resulting costs.

7. Retention of title

The goods remain our property until full payment has been received.

8. Liability for Defects (Warranty)

The statutory provisions on liability for defects apply.
Please report any obvious defects as soon as possible after receiving the goods by e-mail to: kontakt@luneva-fashion.com .

9. Liability

We are fully liable for damages resulting from injury to life, body or health.

We are only liable for other damages in cases of intent or gross negligence.
In the case of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable, typically occurring damage.

Liability beyond this is excluded.

10. Applicable Law

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies to the extent that it does not restrict mandatory legal provisions of the state in which the consumer has their habitual residence.

11. Online dispute resolution / consumer arbitration

The EU Commission provides a platform for online dispute resolution (OS):

We are not obligated to and are not willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. Returns

Please note:
The address provided in the legal notice is not the return address .
Please contact us before returning any items at kontakt@luneva-fashion.com , in order to receive the correct return address.

Returns without prior contact cannot be processed.

13. Final Provisions

Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
